Waiver of Annuity Overpayment

Waiver of recovery of an annuity overpayment to the surviving spouse of a retired member was questioned. Provisions for waiver under 10 U.S.C. 1453 were not applicable in this case. If criteria for terminating collection are met under provisions of the Claims Collection Act of 1966, action may be taken accordingly.
