Highlights

A contractor requested an increase in price under its contract and an increase in its costs for parts and freight. The contractor was not entitled to a price increase since the contracting officer was not on actual or constructive notice of the mistake prior to the award. A variation of 13 percent between the low and next low bid was not sufficient byitself to constitute constructive notice where a broad range of bids was received. The contractor was not entitled to a price increase due to its increased cost of performance since there was no price escalation clause in the contract.
