Request for Recommendation of Cancellation

The protester requested that GAO recommend that a request for proposals be canceled and an earlier solicitation be reinstated. The request for solicitation cancellation and negotiation of a sole source award with the protester was denied since the contracting officer's determination to competitively negotiate was reasonable. The request for reinstatement of an earlier invitation for bids, under which the award to a competitor had been terminated for the convenience of the Government, was not recommended since the Government's needs had changed and could no longer be met by the specifications of the earlier solicitation. There was no basis for consideration of the equities of the situation in which the protester had allegedly been effectively precluded from competition in the absence of specific statutory authority applicable to the request for relief. The fact that the agency did not comply with representations made to a District Court regarding its intentions was for consideration by the court, not by GAO.
