Failure To Submit Technical Data Rendered Bid Nonresponsive

Highlights

The protester objected to the rejection of its bid for failure to submit technical data. The bid was properly rejected as nonresponsive because the purpose of the required data was to enable the agency to determine whether the materials proposed by the bidders conformed with stated technical requirements. The protester's allegation that it was not required to submit test data for proposed material was without merit where the specifications required such data. The protester's allegation that the specifications were restrictive of competition was untimely and not for consideration since it was first filed 5 weeks after the agency's denial of the protester's request for an extension of bid opening.
