YOU HAVE RESUBMITTED MR. TESKE NOW CONTENDS THAT HE SHOULD BE ALLOWED THE EXPENSES OF SALE OF THE 1.14 ACRE TRACT UPON WHICH THE MOBILE HOUSE TRAILER WAS PARKED AND USED AS HIS RESIDENCE AT HIS OLD OFFICIAL STATION. AMONG THE ITEMS IN B-164707 FOR WHICH REIMBURSEMENT WAS CLAIMED WAS THE EXPENSES OF SALE OF LAND UPON WHICH THE EMPLOYEE THERE INVOLVED PARKED HIS MOBILE HOUSE TRAILER AND USED AS HIS LIVING QUARTERS. THIS CLAIM WAS DISALLOWED IN ACCORD WITH THE PROVISIONS OF BUREAU OF THE BUDGET CIRCULAR NO. TESKE LIKEWISE IS UNIMPROVED PROPERTY WITHOUT A REAL ESTATE DWELLING WITHIN THE MEANING OF SECTION 4 OF CIRCULAR A-56. TESKE IS NOT ENTITLED TO REIMBURSEMENT OF SUCH EXPENSES. WHICH IS RETURNED HEREWITH.

YOUR LETTER OF FEBRUARY 18, 1969, REFERENCE 362, REQUESTS RECONSIDERATION OF OUR DECISION OF OCTOBER 24, 1968, B-165255, WHICH DISALLOWED THE CLAIM PERTAINING TO PURPORTED REAL ESTATE COSTS ON A MOBILE HOUSE TRAILER AND 1.14 ACRE TRACT ON THE PART OF MR. LORNE L. TESKE, AN EMPLOYEE OF THE BUREAU OF RECLAMATION, INCIDENT TO PERMANENT CHANGE OF STATION FROM OTHELLO, WASHINGTON, TO MATTAWA, WASHINGTON.

YOU HAVE RESUBMITTED MR. TESKE'S VOUCHER IN THE AMOUNT OF $455.27 WHICH REPRESENTS SALES COMMISSION AND OTHER EXPENSES INCURRED IN THE SALE OF THE TRACT OF LAND (MOBILE TRAILER SITE) INCLUDING A WATER SPRINKLING SYSTEM. THE RECLAIM VOUCHER OF MR. TESKE REDUCES FROM HIS PREVIOUS CLAIM OF $594.33 THE AMOUNT OF $139.06 REPRESENTING THE EXPENSES OF SALE OF THE MOBILE HOUSE TRAILER. MR. TESKE NOW CONTENDS THAT HE SHOULD BE ALLOWED THE EXPENSES OF SALE OF THE 1.14 ACRE TRACT UPON WHICH THE MOBILE HOUSE TRAILER WAS PARKED AND USED AS HIS RESIDENCE AT HIS OLD OFFICIAL STATION.

IN OUR DECISION OF OCTOBER 24, 1968, B-165255, WE REFERRED AT SOME LENGTH TO OUR DECISION OF AUGUST 26, 1968, B-164707 (COPY ENCLOSED). AMONG THE ITEMS IN B-164707 FOR WHICH REIMBURSEMENT WAS CLAIMED WAS THE EXPENSES OF SALE OF LAND UPON WHICH THE EMPLOYEE THERE INVOLVED PARKED HIS MOBILE HOUSE TRAILER AND USED AS HIS LIVING QUARTERS. THIS CLAIM WAS DISALLOWED IN ACCORD WITH THE PROVISIONS OF BUREAU OF THE BUDGET CIRCULAR NO. A-56, SECTION 4, WHICH DOES NOT EMBRACE THE REIMBURSEMENT OF THE COST OF SELLING UNIMPROVED REAL ESTATE. THE 1.14 ACRE TRACT SOLD BY MR. TESKE LIKEWISE IS UNIMPROVED PROPERTY WITHOUT A REAL ESTATE DWELLING WITHIN THE MEANING OF SECTION 4 OF CIRCULAR A-56. ACCORDINGLY, MR. TESKE IS NOT ENTITLED TO REIMBURSEMENT OF SUCH EXPENSES.

THE VOUCHER, WHICH IS RETURNED HEREWITH, MAY NOT BE CERTIFIED FOR PAYMENT.
