PROCUREMENT -Bid Protests - Premature allegation - GAO review DIGEST: Protest that proposed solicitation, which is presently under agency review, should be a small business set-aside and for a term of 1 year is dismissed as premature.

Brazil Van Storage Corp. requests reconsideration of our dismissal of its protest against solicitation No. F04607-90-B-A031, for the movement of household goods to be issued by Norton Air Force Base, California.
On September 26, 1990, Brazil protested to our Office that the solicitation should be a small business set-aside and should be for a contract term of 1 year rather than 4 years. We dismissed the protest as premature on September 27 because the agency advised us that no solicitation had been issued as of that date.
We have been advised by the Air Force that it has not yet issued a solicitation and that the solicitation package is undergoing internal agency review. The solicitation is now expected to be issued sometime in November 1990.
Since the solicitation package is still under review the protest remains premature. When a solicitation is issued, Brazil may file its protest with our Office prior to the bid opening if it finds the terms of the solicitation objectionable.
The dismissal is affirmed.
