YOU WERE DETAILED TO A PFS-5. YOU WERE DETAILED TO THE POSITION OF PAYROLL SUPERVISOR. THE POSTMASTER GENERAL IS AUTHORIZED TO ASSIGN OR DETAIL AN EMPLOYEE FROM TIME TO TIME DUTIES AND RESPONSIBILITIES OTHER THAN THE DUTIES AND RESPONSIBILITIES SPECIFICALLY SET FORTH IN HIS POSITION.

THIS REFERS TO YOUR LETTER OF JUNE 29, 1964, WITH ENCLOSURES, REQUESTING A DECISION FROM OUR OFFICE TO ADJUST WHAT APPEARS TO HAVE BEEN AN INEQUITY IN THE PROMOTION PROCEDURE DURING THE PERIOD FROM FEBRUARY 1961 TO SEPTEMBER 1962, UNDER THE SO-CALLED "JOB FREEZE" ISSUED BY THE POST OFFICE DEPARTMENT.

YOU SAY THAT DURING THE PERIOD IN QUESTION THERE WERE SOME VACANCIES FILLED IN THE MEMPHIS REGIONAL OFFICE BY PROMOTIONS WHILE OTHERS WERE FILLED BY DETAILS WHICH IN SOME INSTANCES COVERED SERVICE AT THE HIGHER POSITION IN EXCESS OF A YEAR.

IN YOUR PARTICULAR CASE THE RECORD SHOWS THAT ON MAY 13, 1961, YOU WERE DETAILED TO A PFS-5, STEP 7, POSITION AND AFTER SERVING 30 DAYS RECEIVED THE HIGHER SALARY RATE. ON JULY 29, 1961, YOU WERE DETAILED TO THE POSITION OF PAYROLL SUPERVISOR, PFS-7, STEP 3, AND REMAINED ON DETAIL IN THAT POSITION UNTIL SEPTEMBER 15, 1962, ON WHICH DATE YOU RECEIVED A PROMOTION THERETO.

WHETHER AN EMPLOYEE SHOULD BE PROMOTED INSTEAD OF DETAILED TO A POSITION IN THE POSTAL FIELD SERVICE APPEARS TO BE A MATTER FOR DETERMINATION BY THE POST OFFICE DEPARTMENT AND NOT OUR OFFICE. WE NOTE THAT UNDER 39 U.S.C. 335 (B), AS THE NEEDS OF THE SERVICE REQUIRE, THE POSTMASTER GENERAL IS AUTHORIZED TO ASSIGN OR DETAIL AN EMPLOYEE FROM TIME TO TIME DUTIES AND RESPONSIBILITIES OTHER THAN THE DUTIES AND RESPONSIBILITIES SPECIFICALLY SET FORTH IN HIS POSITION.
