TO THE GENERAL ACCOUNTING OFFICE A COPY OF WHICH IS ENCLOSED. WHEN THEY WERE UNABLE TO REPORT FOR DUTY BECAUSE OF HEAVY SNOWS WHICH BLOCKED ACCESS ROADS TO THE DEPOT. THE MATTERS RELATED IN COLONEL LEAVITT'S LETTER HAVE BEEN CAREFULLY REVIEWED BUT IN VIEW OF THE ESTABLISHED RULE CONSIDERED IN OFFICE DECISION OF JUNE 17. IT CANNOT BE SAID THAT THE PAYMENTS FOR THE PERIODS OF EXCUSED LEAVE REFERRED TO ARE NOT OF QUESTIONABLE LEGALITY. THE MATTER IS BROUGHT TO YOUR ATTENTION IN ORDER THAT APPROPRIATE ACTION MAY BE TAKEN AT THIS TIME BY YOUR DEPARTMENT TO PREVENT POSSIBLE ILLEGAL PAYMENTS IN THE FUTURE AND THE NECESSITY OF COLLECTING THE AMOUNTS OF SUCH PAYMENTS FROM THE EMPLOYEES AT A LATER DATE.

THERE HAS COME TO MY ATTENTION LETTER OF FEBRUARY 17, 1953, REFERENCE ORDXM-A 240 X 141, FROM COLONEL G. H. LEAVITT, COMMANDING OFFICER, SIERRA ORDNANCE DEPOT, HERLONG, CALIFORNIA, TO THE GENERAL ACCOUNTING OFFICE A COPY OF WHICH IS ENCLOSED, RELATIVE TO EXCUSING SOME 1,300 PER DIEM WAGE BOARD EMPLOYEES FROM DUTY WITHOUT CHARGE TO LEAVE OR LOSS OF PAY DURING THE PERIOD JANUARY 14 TO 23, 1952, WHEN THEY WERE UNABLE TO REPORT FOR DUTY BECAUSE OF HEAVY SNOWS WHICH BLOCKED ACCESS ROADS TO THE DEPOT.

THE MATTERS RELATED IN COLONEL LEAVITT'S LETTER HAVE BEEN CAREFULLY REVIEWED BUT IN VIEW OF THE ESTABLISHED RULE CONSIDERED IN OFFICE DECISION OF JUNE 17, 1952, B-108085 (31 COMP. GEN. 663) TO THE SECRETARY OF THE NAVY, IT CANNOT BE SAID THAT THE PAYMENTS FOR THE PERIODS OF EXCUSED LEAVE REFERRED TO ARE NOT OF QUESTIONABLE LEGALITY. HOWEVER THAT MAY BE, EXISTING REGULATIONS (CIVILIAN PERSONNEL REGULATIONS H2.5, MARCH 1952) RELATING TO THE CLOSING OF INSTALLATIONS, APPEAR TO AUTHORIZE THE EXCUSING OF PER DIEM WAGE BOARD EMPLOYEES WITHOUT CHARGE TO LEAVE OR LOSS OF PAY IN CONTRAVENTION OF 31 COMP. GEN. 663, SUPRA. ACCORDINGLY, THE MATTER IS BROUGHT TO YOUR ATTENTION IN ORDER THAT APPROPRIATE ACTION MAY BE TAKEN AT THIS TIME BY YOUR DEPARTMENT TO PREVENT POSSIBLE ILLEGAL PAYMENTS IN THE FUTURE AND THE NECESSITY OF COLLECTING THE AMOUNTS OF SUCH PAYMENTS FROM THE EMPLOYEES AT A LATER DATE. IT IS REQUESTED THAT THIS OFFICE BE INFORMED OF THE PREVENTIVE MEASURES INITIATED.
