PROCUREMENT - BID PROTEST - MOOT ALLEGATION - GAO REVIEW DIGEST: PROTEST THAT CONTRACTING AGENCY EXTENDED AND EXPANDED THE COVERAGE OF A CONTRACT, BY CONTRACT MODIFICATION, WITHOUT OBTAINING COMPETITIVE BIDS IS ACADEMIC WHERE AGENCY RESCINDS PROTESTED CONTRACT MODIFICATION.

LAND MARK REALTY, INC.:

LAND MARK REALTY, INC. (LAND MARK) PROTESTS THE EXTENSION AND EXPANSION OF COVERAGE, BY CONTRACT MODIFICATION, OF A PROPERTY MANAGEMENT CONTRACT BETWEEN THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) AND GREEN MANAGEMENT CORPORATION (GREEN). LAND MARK CONTENDS THAT HUD WAS REQUIRED TO OBTAIN COMPETITIVE BIDS BECAUSE THE CONTRACT MODIFICATION INCREASED THE VALUE OF GREEN'S CONTRACT BY MORE THAN $25,000. ADDITIONALLY, LAND MARK CONTENDS THAT THE MODIFICATION TO GREEN'S CONTRACT DUPLICATES SERVICES COVERED BY LAND MARK'S PROPERTY MANAGEMENT CONTRACT WITH HUD.
