A firm protested a Federal Bureau of Investigation (FBI) contract award for construction services, contending that it should have received award, since it submitted a lower price than the awardee for the actual work awarded under the solicitation. GAO held that the FBI: (1) improperly evaluated the proposals; and (2) violated relevant procurement regulations governing the determination of the lowest bid. Accordingly, the protest was sustained, and GAO recommended that the FBI: (1) terminate the contract to the awardee, and make award to the protester, if otherwise appropriate; and (2) reimburse the protester for its protest costs.
