[Protest of Army Corps of Engineers Rejection of Bid for Construction Services]

A firm protested the Army Corps of Engineers' rejection of its bid for construction services, contending that its submission of a faxed copy of the power of attorney was sufficient to bind the surety. GAO held that, since the bid documents did not establish that the surety would be bound by such a power of attorney, the bond was unacceptable and the bid was nonresponsive. Accordingly, the protest was denied.
