An employee questions whether his family is entitled to temporary quarters subsistence expenses (TQSE) incident to their early return from the employee's overseas post of duty. The applicable statute limits reimbursement in these circumstances to the travel of the immediate family and the transportation of the employee's household goods. 5 U.S.C. Sec. 5729 (1988). See also FTR Sec. 302-1.12; and 58 Comp.Gen. 606 (1979).

Dear Mr. Hansen:

This further responds to your July 7, 1994, letter transmitting a request for a Comptroller General's decision on Mr.                      claim for temporary quarters subsistence expenses (TQSE) for his dependents in connection with their early return for compassionate reasons from Mr.                       overseas duty station.

Your agency disallowed Mr.                       claim based on Federal Travel Regulation Sec. 302-1.12(e), which implements 5 U.S.C. Sec. 5729 (1988). Under these provisions reimbursement in these circumstances is limited to the travel of the employee's immediate family and the transportation of his household goods. See also, 58 Comp.Gen. 606 (1979), copy enclosed.

We have reviewed the record you furnished, including the material submitted by Mr.                      , and find that the disallowance of the claim was correct. Accordingly, the disallowance is affirmed.
