A Bureau of Reclamation employee claimed entitlement to a higher pay rate, contending that neither his reinstatement nor his promotion set his rate of pay in accordance with the highest-previous-rate rule. GAO held that the claimant: (1) had no vested right to receive his previous highest salary; and (2) failed to present evidence to refute the Bureau's justification for setting his salary. Accordingly, the claim was denied.
