The Army requested a decision regarding whether it could award a contract for an aircraft on a sole-source basis pursuant to an exception permitting other than full and open competition, contending that: (1) legislation mandated it to procure the aircraft on a sole-source basis, since the awardee was the only source that manufactured the desired product; and (2) applicable legislation specifically made reference to the desired aircraft. GAO held that applicable legislation did not include any express authorization or requirement requiring the Army to acquire the aircraft from any particular source. Accordingly, the Army was not required to procure the aircraft on a sole-source basis.
