[Decision Regarding Retroactive Adjustment to Retired Pay]

The Marine Corps requested an advance decision regarding a retroactive downward adjustment for a member's retirement pay to reflect a retroactive increase in his disability pay from the Department of Veterans' Affairs (VA). GAO held that: (1) since the claimant's disability pay was increased retroactively, and he earlier waived retired pay equal to his disability compensation, the Corps should retroactively adjust his retirement pay; and (2) it would not object if the Corps determined that waiver of the claimant's former spouse's debt due to overpayments was appropriate. Accordingly, the Corps should retroactively adjust the claimant's retired pay.
