The widow of a deceased retired Navy member claimed entitlement to his Survivor Benefit Plan annuity, contending that she accidently shot and killed her husband. GAO held that the claimant was entitled to the annuity, since her involuntary manslaughter conviction did not establish felonious intent under applicable state law. Accordingly, the claim was allowed.
