The Navy requested a decision concerning whether a retired civilian employee was entitled to compensatory time incident to a promotion denied to her because of age discrimination. GAO held that the claimant was entitled to the compensatory time at overtime rates, since she retired before receiving the backpay award and could not use the compensatory time due to actions that were beyond her control. Accordingly, the claim was allowed.
