A firm requested reconsideration of its dismissed protest under a Defense Logistics Agency (DLA) solicitation for milk and dairy products, contending that, since it made a good faith effort to comply with GAO timeliness requirements, its protest should be considered. GAO noted that DLA resolicited the requirement under two separate solicitations, but cancelled the resolicitation for commissary resale because proposed prices did not reflect the lowest overall cost available to the government. GAO held that the protester: (1) untimely filed its protest after initial adverse agency action; (2) did not raise issues significant to the procurement community; and (3) did not support its contention that DLA acted in bad faith. Accordingly, the request for reconsideration was denied.
