[Protest of Air Force Contract Award for Milk and Dairy Products]

A firm protested an Air Force contract award for milk and dairy products, contending that: (1) the contracting officer made his affirmative determination of the awardee's responsibility fraudulently and in bad faith; and (2) the Air Force either did not evaluate the awardee's bid consistently with the stated criteria, or improperly relaxed certain specifications for the awardee's benefit. GAO held that the protester failed to show that the Air Force improperly relaxed the solicitation specifications for the awardee's benefit. GAO would not: (1) consider the protester's contention that the awardee was unable to meet the solicitation's requirements, since that was a matter of contract administration; or (2) review the contracting officer's affirmative determination of the awardee's responsibility. Accordingly, the protest was dismissed in part and denied in part.
