A firm protested a Department of Health and Human Services (HHS) contract award for hospital repairs, contending that HHS: (1) improperly accepted the awardee's unreasonably low bid; and (2) should terminate the contract, since the awardee did not provide acceptable payment and performance bonds within the required time period. GAO would not consider the protest, since: (1) a below-cost bid was not legally objectionable; and (2) the awardee's fulfillment of payment and performance bond requirements was a matter of contract administration. Accordingly, the protest was dismissed.
