A Defense Logistics Agency (DLA) employee requested a decision concerning his claim for leave restoration. DLA restored 81 hours of leave he could not use because of a long illness at the end of the leave year, but disallowed restoration of 8 hours scheduled during an administratively declared legal holiday. GAO held that the claimant was also entitled to restoration of the remaining 8 hours of leave, since: (1) the claimant had timely scheduled his leave to avoid forfeiture; and (2) it was reasonable to presume that the claimant would have scheduled his leave to avoid forfeiture for the legal holiday. Accordingly, the claim was allowed.
