A firm protested a Navy contract award for circuit breakers, contending that the Navy improperly reopened negotiations to take advantage of significantly lower prices that the awardee offered in a late modification to its best and final offer (BAFO). GAO held that: (1) regulations did not preclude the Navy from reopening discussions after BAFO submission when it was clearly in the government's best interest to do so; and (2) all the bidders were afforded the same opportunity to revise their offers in response to the reopening. Accordingly, the protest was denied.
