A firm requested reconsideration of the dismissal of its untimely protest of an Army contract award for meals and lodging of military recruits. GAO had held that the protester untimely protested an alleged solicitation defect after bid opening. In its request for reconsideration, the protester contended that: (1) it was unaware of the alleged defect until after award; and (2) an incorporated collective bargaining agreement required the Army to make award to a unionized firm. GAO held that: (1) it properly dismissed the protest as untimely; (2) the solicitation required only the wage rates specified under the agreement; and (3) it would not consider the matter as a significant issue. Accordingly, the dismissal was affirmed.
