The Department of the Army requested a decision as to whether it could properly include an overseas living quarters allowance in a backpay settlement award to a civilian employee in a religious discrimination complaint settlement. GAO noted that an Army review found that religious discrimination had occurred. GAO held that, although the employee was not wrongfully discharged, he resigned as a result of the discrimination. Accordingly, the inclusion of the living quarters allowance was allowed.
