[Decision Concerning HUD Employee's Claim for Backpay]

The Department of Housing and Urban Development requested a decision concerning the legality of awarding retroactive backpay pursuant to a negotiated grievance decision order. GAO held that it would not disrupt the arbitration process, since the union had already initiated negotiated grievance procedures to resolve the issue, and objected to the submission of the matter to GAO. Accordingly, GAO declined to assert jurisdiction.
