A former naval employee requested reconsideration of the denial of his claim for additional backpay resulting from his procedurally defective separation from employment. GAO had denied the employee's original claim for backpay for those periods when he was unavailable to perform the duties of his position. In his request for reconsideration, the protester contended that the GAO decision was not in conformance with the Merit Systems Protection Board's decision that he was entitled to current reinstatement and to an opportunity to make a claim for backpay. GAO held that the employee failed to show that the original decision contained any factual or legal error which would warrant reversal. Accordingly, the denial was affirmed.
