The Food and Drug Administration (FDA) requested a decision concerning whether three employees were entitled to receive overtime pay for time they spent in travel status. FDA denied the employees' claims for overtime pay for non-duty travel hours on the basis that they could have traveled the following day. GAO found that the record showed that the employees complied with a request that they travel immediately and the agency set their departure time in response to that request. Accordingly, the claims were allowed.
