A firm requested reconsideration of its denied protest against a Department of Health and Human Services (HHS) proposed post-bid-opening solicitation cancellation. GAO had concluded that HHS had a compelling reason to cancel the solicitation since all of the acceptable bids were unreasonably priced. In its request for reconsideration, the protester: (1) contended that GAO erred in concluding that its bid price was unreasonable; and (2) renewed its claim for bid preparation costs. GAO held that: (1) since the protester would not have been in line for award even if its protest were upheld, it was not an interested party; and (2) the protester failed to demonstrate that HHS took actions with the intent to harm it or any other small business. Accordingly, the request for reconsideration and the claim for costs were denied.
