A firm requested reconsideration of the dismissal of its protest against a Navy contract award, contending that: (1) it met all timeliness requirements for filing a bid protest; (2) the Navy failed to withhold the contract award until resolution of its agency-level protest concerning overseas firms and international mailing delays; and (3) its protest contained new information on the awardee's improprieties. GAO determined that: (1) the protest, although timely received from the date it was mailed, was dated 2 days prior to the actual mailing and was, therefore, untimely; (2) the time period for filing bids does not discriminate against overseas firms since they can avoid mailing delays by transmitting their bids by other means; and (3) it would not review a matter of contract administration. Accordingly, the prior decision was affirmed.
