A District of Columbia Superior Court judge requested an opinion on whether the Equal Employment Opportunity Commission (EEOC) has jurisdiction over employment discrimination complaints against the Court. GAO noted that: (1) Superior Court employees are not in the competitive service; and (2) although Congress established the Court, it functions as a state or local court under the Civil Rights Act of 1964. Accordingly, the Superior Court is, therefore, subject to EEOC investigative jurisdiction.
