A Bureau of Land Management employee requested reconsideration of the Claims Group's denial of his request for waiver of the overpayment he received when he was erroneously paid a cost-of-living allowance. GAO found that: (1) the erroneous payments were made after the employee was promoted to a wage-grade position and was no longer eligible for the cost-of-living allowance; (2) the employee's Notification of Personnel Action Form indicated that he was no longer eligible for the allowance; (3) the employee's leave and earnings statements reflected that he was being paid the allowance; and (4) the employee should have been aware of the overpayment and should have brought it to the attention of the proper authority immediately. Accordingly, the Claims Group's decision was sustained.
