[Request for Reconsideration of Decision Dismissing Protest of DOE Solicitation]

For the second time, a firm requested reconsideration of a decision which dismissed its protest of a Department of Energy (DOE) procurement for being untimely. The requester argued that it protested to DOE, but that this time period was not considered when calculating the period in which the protest was to be filed with GAO. However, since the requester failed to show that it had filed a protest with DOE, the protest to GAO was properly found to be untimely. Further, the initial reconsideration request was also untimely filed. Accordingly, the prior dismissals were affirmed.
