[Claim for Retroactive Temporary Promotion and Backpay]

An Indian Health Service employee filed a claim for a retroactive temporary promotion and backpay. GAO noted that the basis for the claim had been overturned in a decision made prior to the claim's settlement. GAO has held that, after voiding that basis, claims of this nature were no longer valid. Accordingly, the claim was denied. Although the agency's apparent misplacement of the claim while it was being considered which could have prevented an earlier and successful settlement, such an error does not allow for consideration of the claim.
