A firm requested reconsideration of a decision which denied its protest that: (1) due to the oral advice of a procuring official, it failed to submit its lowest price in its best and final offer; and (2) the procuring activity improperly accepted a price reduction from an otherwise low offerer. Defense Acquisition Regulations allow the acceptance of late modifications which make the terms of a proposal more favorable to the government. Furthermore, GAO found that the protester's contention that the contract was improperly awarded by a procuring official other than the contracting officer was incorrect. In its request for reconsideration, the protester reiterated these contentions and complained that GAO failed to fully investigate its complaints. Since the protester failed to show any error of fact or law in the prior decision, and it had been advised that oral representations were not binding on an agency, the prior decision was affirmed.
