[Protest of Agency Failure To Restrict Solicitation]

A firm protested a Navy contract award, complaining that the procurement should have been set aside for small businesses and labor surplus area concerns. Bid protest procedures require that protests based on alleged improprieties in the solicitation must be filed prior to bid opening. The protest was not filed in that time period. Accordingly, the protest was dismissed.
