GAO was asked to determine the entitlement of an Equal Employment Opportunity Commission (EEOC) employee to a retroactive salary increase and backpay. EEOC hired the employee at grade GS-14, step 3, but through an administrative oversight failed to obtain the approval of the Office of Personnel Management (OPM). The employee thus entered service at grade GS-14, step 1. The error was subsequently discovered and OPM approval for an increase was obtained. GAO held that there was no basis upon which to grant a retroactive increase or backpay.
