Highlights
A firm requested reconsideration of a prior decision which denied its protest as untimely filed. The firm initially had protested the agency's consideration of prompt-payment discounts in its evaluation of proposals. In its request for reconsideration, the protester contended that: (1) the alleged impropriety was not apparent prior to bid opening and, therefore, its protest against the agency's consideration of the discounts was timely filed; and (2) the solicitation prohibited the consideration of prompt-payment discounts. GAO found that: (1) the solicitation placed bidders on sufficient notice that the agency would consider prompt-payment discounts; and (2) the protester failed to raise any new fact or demonstrate an error of law which would justify reversing the prior decision. Accordingly, the prior decision was affirmed.
