A firm protested a proposed Navy contract award, alleging that the proposed awardee did not comply with the licensing provisions of the solicitation and was not qualified for award of the small business set-aside because of its size status. Failure of a contractor to obtain all the necessary licenses under solicitation specifications is a matter to be resolved between the contractor and State or local authorities and does not warrant rejection of a low bid. Further, this matter concerned an affirmative determination of responsibility which GAO will not review absent circumstances not present in this case. In addition, GAO does not consider size status protests since the Small Business Administration has exclusive jurisdiction over this question. Accordingly, the protest was dismissed.
