A firm protested the propriety of a Navy cost comparison to determine whether to perform certain services in-house or to award a commercial contract for the services. The protester also filed a suit with a U.S. court seeking relief which involved the same issues raised in the protest. GAO does not render a decision where the issues raised are pending before a court of competent jurisdiction unless the court expresses an interest in the decision. Since the court did not express such interest, the protest was dismissed.
