A firm requested reconsideration of a decision in which GAO upheld the Army's rejection of the protester's bid as nonresponsive for failure to acknowledge material solicitation amendments. The protester had not received the amendments because it was not on the Army's bidders mailing list. The Army explained that it was unaware of the protester's interest in the solicitation until the bids were opened. In its request for reconsideration, the protester disputed that contention, alleging that, since the Army mailed the solicitation to the protester, it must have been aware of the protester's interest in the solicitation. GAO held that there was nothing to suggest that the Army's failure to include the protester on the mailing list was a deliberate attempt to exclude it from the competition. Accordingly, the prior decision was sustained.
