A firm protested a Department of Energy (DOE) operating contractor's awards which were small business set-asides. The protester questioned the size standard under which the awardee was determined to be a small business. DOE and the Small Business Administration (SBA) found that the awardee met the small business size standard required by Federal Procurement Regulations for concerns bidding on contracts to supply refined petroleum products. Because SBA has conclusive authority to determine matters of small business size status for Federal procurement purposes, GAO does not consider such protests. Accordingly, the protest was dismissed.
