A former Government Printing Office employee appealed a Claims Group action which denied his claim for a retroactive temporary promotion and backpay incident to an overlong detail. The employee based his claim on previous GAO decisions which ruled in favor of an employee's right to a retroactive promotion and backpay incident to an overlong detail. However, a recent Court of Claims ruling held that the statute used to grant the claim was not applicable, and it did not authorize a retroactive temporary promotion and backpay. Therefore, with respect to such claims arising subsequent to this ruling, GAO will not follow its earlier decisions. Accordingly, the claim was denied.
