Request for Reconsideration of Retroactive Promotion and Backpay Claim

A former employee of the Defense Supply Agency requested reconsideration of a decision which denied her claim for a retroactive promotion and backpay incident to an overlong detail. The claim was based on previous GAO decisions which granted these benefits to employees in such circumstances. However, a recent Court of Claims ruling held that the statute used to grant the claim did not authorize a retroactive promotion and backpay in cases involving overlong details. Therefore, with respect to all claims submitted after the ruling, GAO will no longer follow its previous decisions. Accordingly, the claim was denied.
