Request for Retroactive Temporary Promotion and Backpay

An Army engineer requested reconsideration of a disallowance of his claim for a retroactive temporary promotion and backpay. The claim was denied by the GAO Claims Group because the employee was detailed for less than the requisite 240 days. In his appeal, the employee stated that he performed the higher grade duties for more than 240 days if the period of his temporary promotion is taken into account. Therefore, he contended that he was entitled to additional compensation. GAO stated that, to be eligible for backpay, an employee must be detailed to a higher grade position for 240 days without additional compensation. Further, the 240 days must be computed excluding any period during which the employee was temporarily promoted to that higher grade position. Since the employee did not meet this requirement, GAO held that he was not entitled to a retroactive temporary promotion. Accordingly, the actions of the Claims Group were affirmed.
