A labor union protested the Department of Labor contracting for certain computer services rather than having them performed in-house. The agency's decision was made under the guidance of Office of Management and Budget Circular A-76. GAO has consistently declined to consider protests concerning the propriety of agency decisions to contract out in lieu of performing work in-house on the basis that they involve matters of executive branch policy which GAO does not view as part of its bid protest function. GAO does consider protests which allege a faulty or misleading comparison. However, GAO review of these cases does not extend to nonbidders. Accordingly, the union's protest was not considered.
