Request for Reconsideration

A firm requested reconsideration of a previous decision which dismissed its protest of the Army's setting aside a procurement under section 8(a) of the Small Business Act. The firm complained that the procurement was too technically complex for a small business and that the particular firm which would receive the subcontract was not competent to perform the work. Determination of these matters are the exclusive province of the Small Business Administration. GAO will review Small Business set-aside decisions only if there has been a showing of bad faith or fraud on the part of Government officials. GAO found nothing in the firm's request for reconsideration that had not been previously considered. The decision dismissing the protest was affirmed.
