Claim for Retroactive Temporary Promotion and Backpay]

An employee of the Department of the Navy appealed the denial of his claim for retroactive temporary promotion and backpay. The employee who was promoted to a GS-14, asserted that he was assigned responsibilities commensurate with a higher grade level, and that his duties equaled or exceeded those performed by his GS-15 predecessor. In addition, he argued that the Navy's reclassification of his position constituted proof that he had been performing the higher grade level duties. As a general rule, an employee is entitled only to the salary of the position to which he is officially appointed regardless of the duties performed. Futhermore, the employee's classification claim was not within jurisdiction of GAO. Accordingly, the disallowance of the employee's claim was sustained.
