Highlights

A civilian employee of the Army appealed the action of the Claims Division which disallowed her claim for overtime compensation. A portion of her claim was received after the date for consideration had passed, thus this portion of the claim could not be considered. The claimant stated that she did not receive compensation or compensatory time off for overtime hours which she had worked for her immediate supervisor and other division officials. The claim was denied because she had not presented evidence to show that the alleged overtime work was affirmatively induced by an authorized official. She had been awarded outstanding performance ratings and merit increases for voluntarily and consistently working after normal duty hours with no request for compensatory time off. Her immediate supervisor did not keep records of her overtime as he expected her to take compensatory time off during his absence. The claim was of doubtful value due to the lack of records. The disallowance of the claim by the Claims Division was sustained.
