A firm requested reconsideration of a decision which was rendered in response to an expression of interest from a court in connection with the firm's complaint filed before it. The request for reconsideration was filed on the ground that GAO had imposed a new standard of proof on the firm. The firm stated that it was in the process of producing the evidence to meet that standard. The record indicated that the matter involved in the protest was not the subject of pending litigation and no court expected a response from GAO to reconsider its earlier decision. Thus, the reconsideration request was not for consideration within the policy applicable to decisions requested by courts. GAO declined to reconsider the matter because the required detailed statement concerning the factual or legal basis to modify or overturn the previous decision was untimely filed. The protest was dismissed.
