Untimely Request for Reconsideration of Decision

A firm requested reconsideration of a decision in which it was held that the protester failed to show that prospective suppliers for construction projects were falsely certifying that some of their materials had been approved by the Government as substitutes for other material covered by their Government-issued "Letters of Acceptability." In this request for reconsideration, the protester submitted a letter to the supplier from the agency revoking its "Letters of Acceptability." The protester contended that this letter proved its claim of fraud on the part of the suppliers. GAO Bid Protest Procedures require that a request for reconsideration be filed not later than 10 working days after the basis for reconsideration is known or should have been known. This request was filed more than 10 days after the basis for the protest was known. Therefore, it was dismissed as untimely.
